Allahabad High Court Reverses UPPSC PCS 2021 Pre-Result Cancellation Order

According to the commission's advocate Avnish Tripathi, the division bench determined that the PCS Pre 2021 result issued by the Uttar Pradesh Public Service Commission was completely correct and that the commission had fully complied with the reservation rules.

The order of the single bench in the matter of cancelling the results of the UP PCS 2021 preliminary examination was overturned by a division bench of two judges of the Allahabad High Court. The cancellation of the single bench order now clears the way for the commission to release the final result.

A division bench of Chief Justice Rajesh Bindal and Justice JJ Munir issued the order. According to the commission’s advocate Avnish Tripathi, the division bench determined that the PCS Pre 2021 result issued by the Uttar Pradesh Public Service Commission was completely correct and that the commission had fully complied with the reservation rules.

After hearing the petition of Junior Warrant Officer Satish Chandra Shukla and three others, the single bench canceled the preliminary examination result for failing to provide the prescribed five percent reservation to ex-servicemen and issued the revised result, which provided the benefit of reservation to ex-servicemen. The Single Bench determined that the notification granting ex-servicemen reservation in Group B posts was issued on March 10, 2021. It went into effect on the date it was issued. To apply for PCS, the portal was open until March 17. If the Commission and the government had intended to provide reservation, the benefit of reservation could have been provided to the candidates during this time period, but it was not.

According to the commission’s counsel, the entire result was canceled for only two candidates. The application deadline for PCS Pre was March 10, 2021. Later, until March 17, the portal was only open to candidates who had made an error in their application. He was given the opportunity to correct the error. This portal was not made available for new applications. The petitioner’s counsel argued that the result is not completely void because the Commission conducted the interview despite the High Court’s order.

The petitioner’s counsel also stated that the selection process will be considered to begin on the date of the main examination. The main exam began on March 23, 2022. The government, according to Advocate General Ajay Mishra, supports the commission’s recommendations. It is not a good idea to cancel the entire outcome for just two candidates. Several other technical issues were raised by both parties, after which the bench reserved its decision on September 6. On August 5, the Public Service Commission completed the interview process for 623 PCS-2021 positions.
