BSSC: In case of non-submission of non-creamy layer certificate by the reserved category candidates in the Inter-Level Combined Competitive Examination, they cannot be denied the job. After hearing the matter, the Patna High Court has ordered to include all such candidates in the selection process.
A single bench of Justice Madhuresh Prasad heard the matter. The court has asked the Bihar Staff Selection Commission to file a counter-affidavit by August 23 to clarify the situation. Advocate Rashid Izhar, on behalf of the applicants, told the court that the Bihar Staff Selection Commission issued an advertisement in 2019 and sought applications. Reserved category candidates had to submit a fresh non-creamy layer certificate generated after the cut off date. Meanwhile, due to the arrival of Corona, they could not submit the certificate. Now the Commission is refusing to accept the old certificate. Referring to the decisions of the Supreme Court and the High Court, he said that the candidates should be included in the selection process.
On the other hand, the commission opposed the application of the candidates and pleaded for dismissal of it. The court ordered not to object on the basis of non-creamy layer certificate. Also asked the candidates to include them in the selection process. At the same time, the court made it clear that inclusion in the selection process would not entitle the candidate to the selection. Their candidature will depend on the final outcome of this case. The court fixed August 23 for the next hearing on the matter.
