High Court Dismisses Plea Challenging Re-Advertisement of 4476 PGT Posts by HPSC

High Court Dismisses Plea Challenging Re-Advertisement: The Punjab and Haryana High Court in Chandigarh has dismissed the petition challenging the recently advertised 4476 Post Graduate Teacher (PGT) positions by the Haryana Public Service Commission (HPSC).

In this case, the petitioner contested the two-tier written examination criteria outlined in the HPSC’s monthly re-advertisement.

The petition lodged by Ashwani Kumar and others has been dismissed by a single bench presided over by Justice Tribhuvan Singh Dahiya of the High Court.

High Court Dismisses Plea Challenging Re-Advertisement of 4476 PGT Posts by HPSC

The petitioners primarily contested the HPSC’s re-advertisement of 4,476 PGT positions in various subjects for the state’s secondary education department, which was published on June 24.

The HPSC re-advertised these positions after withdrawing the previous advertisement issued on November 19, 2022, in response to a number of petitions filed with the Punjab and Haryana high court challenging the eligibility requirements outlined by the HPSC for these positions.

The previous petition primarily contested the criteria for administering the written examination on the grounds that the commission initially announced the written examination would consist of multiple-choice questions, but later announced that both the preliminary and main examinations would consist of subjective-type questions.

After the High Court halted the entire recruitment process based on the criteria, the advocate general (AG) of Haryana testified on May 29 regarding the withdrawal of the November 2022 advertisement.

The HPSC re-advertised these positions on June 24 based on the same criteria, announcing a two-tier written examination for these positions.

On Monday, the same was challenged again before the HC. The petitioners had requested that the challenged criteria by which the HPSC re-advertised the positions be nullified.

The petition was, however, dismissed by the HC, which upheld the HPSC’s advertised criteria.

However, the detailed copy of the order was not uploaded until the current report was filed.

Vacancies advertised after 2019

Importantly, the youth of Haryana have been waiting for these positions for approximately four years, as the Haryana Staff Selection Commission (HSSC) initially advertised them on August 26, 2019. As these positions fell under the Group-B category, the advertisements were retracted and sent to the HPSC in order to complete the recruitment process. Consequently, the November 2022 HPSC advertisement for these positions was also withdrawn due to legal obstacles. Now, these positions have been advertised a third time.
