Himachal HC takes serious note of denial of admission: The Himachal Pradesh High Court has taken note of the denial of admission to the MBBS course against the vacancy created by the cancellation of admission for two students who forged their NEET Mark sheet. National Medical Commission, New Delhi, and Atal Medical and Research University, Nerchowk, Mandi, have been ordered by the court to pay Rs 2 lakh as compensation to the petitioner within four weeks for causing him to forfeit an entire academic year.

In response to a petition submitted by one Sanjna Thakur, a Division Bench composed of Chief Justice M S Ramachandra Rao and Justice Ajay Mohan Goel issued the following decision.

Two students who had been granted admission to Pandit Jawahar Lal Nehru (PtJLN) Government Medical College, Chamba and IGMC Shimla, respectively, had forged their NEET Mark sheet, and their admission was revoked because the documents they submitted did not match the information available on the National Medical Counsel Portal.

Thus, two MBBS undergraduate seats became available at IGMC, Shimla, and Pt JLN GMC, Chamba. On January 17, this year, the Registrar of Atal Medical and Research University, Nerchowk Mandi, wrote to the National Medical Commission, New Delhi, requesting permission and instructions to fill the two vacant seats as soon as possible.

The petitioner argued that, as the holder of the next-highest rank in the General Category, she should be awarded the vacant General Category seat at Pt JLN Government Medical College, Chamba. The petitioner filed the instant writ petition on January 28 after complaining to multiple authorities, including the Chief Minister of Himachal Pradesh.

The court was astounded by the utter callousness and irresponsibility of the aforementioned respondents, who failed to file a response in the matter of admission to the MBBS course, for which the academic session had begun in November of last year.

The court noted that the petitioner is without a doubt meritorious and is immediately next on the merit list of candidates prepared after the Second Round of Counselling for 2022, and is therefore eligible for admission to the General Category MBBS Seat at the Pt JLN Government Medical College, Chamba. The court determined that the petitioner is not at fault in this case and that she pursued her rights and legal remedies expeditiously and without delay.

The court has ordered that the petitioner be admitted to the MBBS programme at PTJLN Government Medical College, Chamba, for the academic year 2023-2024, and has directed the respondents to increase the number of seats allocated to the college by one for that academic year. The court has ordered the above-mentioned respondents to pay the petitioner a total of two lakh rupees in compensation and ten thousand rupees in costs.
