Patna High Court orders to investigate 2459 aided madrasas of Bihar

The division bench of Chief Justice Justice Sanjay Karol and Justice Partha Sarathi, Mo. of Sitamarhi, met on Tuesday. This order was issued during the hearing on Alauddin Bismil's application.

Two and a half thousand Bihar madrassas will be investigated. After November 29, 1980, the Patna High Court directed the Additional Chief Secretary of the Education Department to investigate 2459 state-funded madrassas. The High Court convened a meeting with all of the state’s District Magistrates and asked them to inquire about their resources. It was also ordered that no grant money be given to 609 madrassas until the investigation was completed. In addition, the court ordered the DGP to provide complete information to the court regarding the research done in connection with the FIR registered regarding the recognition given to Madrasas on forged documents.

According to the applicant’s lawyer, Rashid Izhar, grants are being given to open madrasas based on forged documents. In response, the court directed the education department to conduct an investigation into all 2459 madrasas. In addition, the court ordered a thorough investigation into other aspects, including their resources, under the Madrasa Act. The next hearing will be held on February 14.

What is the problem?

Petitioner’s lawyer, Rashid Izhar, told the court that the Special Director of Secondary Education, Mohd. Tasnimur Rahman, had provided an investigation report on the madrasas in Sitamarhi that were receiving government funds. According to the report, approximately 88 madrassas in the district have received government grants on forged documents. They discussed taking action by filing a FIR against all of them. Deepak Kumar Singh, Additional Chief Secretary, Education Department, filed a counter-affidavit in the High Court, claiming that a three-member committee has been formed to investigate all 609 madrassas in other districts that have received government grants. Khagaria, Banka, Begusarai, Katihar, Madhubani, Muzaffarpur, Kishanganj, Sheohar, Siwan, Bhagalpur, East Champaran, Patna, Purnia, West Champaran, Rohtas, Sheikhpura, Samastipur, Saharsa, Sitamarhi, Saran, Supaul, Darbhanga, Vaishali Araria In charge of investigating madrassas in the districts of Aurangabad, Gaya, and Gopalganj. The Additional Chief Secretary also reminded the DMs of these districts for failing to submit the inquiry report to the department within the deadline. However, the report only came from Sitamarhi. The report of the cancellation of grant of 88 madrassas in the district has been given in this. In response, the High Court ordered an investigation into 2459 madrassas.
