The background of Magna Carta Day

The issuance of the Magna Carta was a reaction to years of excessive taxation demands and ineffective foreign policy by King John of England. By 1215, he had consented to sign a charter of liberties that placed him and all future English sovereigns under the rule of law. This legal document is known as the Great Charter or ‘Magna Carta.’ In addition to limiting the power of the English monarch, it also establishes and records the rights of the free citizens. However, the initial test was less successful than anticipated. It was modified and reprinted in 1216, 1217, and 1225. Henry III, John’s predecessor, led this effort in an effort to acquire more men to his side.

Certain clauses, such as the monarch’s authority to raise funds or dispatch troops to war, were eliminated from the version of 1216 compared to the original document. In addition, the church lost its authority to free elections. A year later, it was revised again for clarity and precision. By 1225, the Magna Carta represented the struggle against oppression.

Later, the Magna Carta became a foundational document for the protection of the liberties of every free man. This was reflected in the 1628 Petition of Right and the 1679 Habeas Corpus Act, which reaffirmed that no free man shall be punished or imprisoned in the absence of a legal verdict. In the 17th century, this had a significant impact on Anglo-American law, influencing the Constitution of the United States of America in 1789, the Bill of Rights in 1791, and the Fourteenth Amendment in 1868.
