Understanding Encumbrance: Definition and Explanation

Encumbrances, such as mortgages, liens from taxes, leases, encroachments, and easements, are claims made by someone other than the owner, limiting the use or transfer of property.

Since he does not own the land or property he has encroached onto, neither the landlord nor the person who did the encroachment can utilize it freely.
