Airline’s ‘Contract of Carriage’ Falls Short in Rainy Conditions: A businessman in Central Florida received complete reimbursement from Southwest Airlines for his destroyed business brochures due to the efforts of News 6.
Herb Gingold, a News 6 viewer, sought assistance from Make Ends Meet after an airline denied his request for $627 to cover the cost of 250 confidential business brochures “sitting in water.”
When the morning flight from Orlando to Denver took off from OIA, there was heavy rain. Gingold hypothesised that the luggage was left in the shower and struck by lightening outside the baggage compartment.
When he arrived at the hotel, the pamphlets he had carried with him to Denver were water-damaged. Southwest Airlines declined to compensate him for the damage, citing a provision in the contract of carriage.

Following a request from News 6, the airline credited Gingold’s account with $627. A Southwest representative wrote in an email, “You are a valued Customer, and we look forward to serving you again in the future.”
