VA Survivor Benefits Eligibility: The unmarried spouses and children of veterans of wartime get tax-free monthly payments under the VA Survivors Pension benefit. You have to meet the requirements set forth by Congress in order to receive the benefit.

To find out if you qualify for the pension, you must first ascertain whether the veteran satisfies the requirements.

For you to be qualified for the benefit, the veteran needs to:

  • Have served in the military for at least ninety days after entering active duty on September 7, 1980, or before.
  • Have been called up and served the whole duration of their call, or at least 24 months, since September 7, 1980, when they were placed into active duty.
  • Been an officer since October 16, 1981, and started active duty after not having been on active duty for at least 24 months.
  • Having been released from service under circumstances other than dishonourable

VA Survivor Benefits Eligibility

Essentially, your total wealth needs to be less than the caps imposed by Congress. Net worth is the total of all your assets less your obligations, excluding your home, the majority of car brands, and the majority of furniture.

The benefit is only available to surviving children who are younger than 18 years old. They must be permanently disabled and unmarried if they are older than 18. If you are between the ages of 18 and 23, you must enroll in a school that has received approval from Veterans Affairs (VA).

If you are incapacitated, your illness must have started before the age of eighteen and keep you from caring for yourself.

Yes, is the easy response. To be eligible for the pension, though, you also need to fulfill the requirements set down by Congress.

Apart from the upper restriction on your net worth, you also need to be single. To marry a veteran after being divorced, your prior marriage had to have terminated before November 1, 1990.

Who qualifies for VA Survivor Benefits?

  • Before the veteran’s passing, you had to be married to them for at least ten years.
  • Or have been married for at least five years before the veteran’s death, starting on the date of the veteran’s discharge.
  • Or, if the veteran was a former prisoner of war, to have been married for a minimum of a year prior to the veteran’s passing.
