Apple will shortly pay between $310 million and $500 million to approximately 3 million users of older iPhone models, according to a statement from Apple customer attorneys. Payments will be made to users who lodged claims against the tech giant in 2020 for the issue known as “batterygate.”

“[W]e can now provide immediate cash payments to affected Apple customers,” said Mark C. Molumphy, a partner at Cotchett, Pitre & McCarthy, one of the law firms representing Apple customers in the lawsuit.

The settlement comes after a judge rejected Apple’s appeal of a class-action lawsuit filed against the tech behemoth in 2017, paving the way for “consumers impacted by software throttling” to receive settlement payments, according to the claimants’ attorneys.

“Software throttling” refers to Apple’s provision of software updates for iPhone models with low-capacity batteries that degraded over time. When an ageing battery was detected, the iOS updates slowed down the overall performance of users’ iPhones to prevent the devices from shutting down completely during “peak current demands.”

Apple told the Verge in 2017 that the reason for reducing performance, or throttling, was not to trick consumers into purchasing an unnecessary iPhone upgrade — which only required a new battery — but to extend the life of the devices. Once the deteriorated battery was replaced, the iPhones would resume their normal velocities.

According to the claim website, the settlement is not an admission of misconduct on the part of Apple.

Mark C. Molumphy, an attorney, told CBS MoneyWatch that a claimant can expect to receive approximately $65 from Apple.

“It could be higher, as much as $85 to $90, depending on the number of claims submitted,” he added.

Generally, fewer complaints imply larger payouts for each individual claimant.

A legal document indicates that approximately 3.3 million iPhone users submitted claims prior to the deadline, meaning they could each receive $128, minus any court-ordered deductions for attorney’s fees and other costs.

Who is qualified for a settlement payment?

The settlement website indicates that owners of iPhone 6, 6 Plus, 6S, 6S Plus, and SE models running iOS 10.2.1 or later and iPhone 7 and 7 Plus running iOS 11.2 prior to December 21, 2017 may be eligible to receive payments.

However, only affected users who submitted claims by the deadline of October 6, 2020 are eligible to receive a cheque.

Apple and attorneys representing Apple customers did not immediately respond to CBS MoneyWatch’s requests for comment.

Why has it taken so long for individuals to receive their funds?

ClassAction.org, a resource for class-action consumers, reports that the majority of class actions are resolved within two to three years, though some may take longer, especially if a court decision is appealed.

The batterygate class-action litigation has been dragged out by court procedures and the appeals process, delaying the time until claimants receive compensation.
