Tiktok Controversy Spreads: As the first state, Montana makes a statement by banning the app

It is widely predicted that TikTok will challenge the measure in federal court. Together with other organisations, such as the ACLU

TikTok Controversy Spreads: Montana was the first state to prohibit the viral video software TikTok. Governor Greg Gianfort signed Senate Bill 419 on Wednesday, asserting he did so to protect residents’ personal information. He implied that the Chinese government presented a danger.

According to Governor Gianforte, it is “well-documented” that the Chinese Communist Party used TikTok to eavesdrop on Americans, invade their privacy, and obtain their personal, private, and sensitive information.

According to our knowledge, the Chinese government has never accessed TikTok user data. Critics of TikTok, however, point out that Chinese law grants the government access to a company’s client database.

If discovered to be in violation of Montana law, programme stores like the Google Play Store and the Apple App Store, where this programme can be downloaded, face daily fines of up to $10,000. The prohibition will go into effect on January 1, 2024.

Tiktok Controversy Spreads

It is widely predicted that TikTok will challenge the measure in federal court. Together with other organisations, such as the ACLU, it has argued that the restriction is unconstitutional. Gianforte removed TikTok from state-issued computers and mobile devices in December.

He expanded the scope of the ban on Wednesday to include “all social media applications that collect and provide users’ personal information or data to a foreign adversary, or a person or entity located within a country designated as a foreign adversary.”

If ByteDance, the parent company of TikTok, is unable to find a buyer in the United States, President Biden has signed legislation prohibiting the app from government devices and is considering a total prohibition.

For national security reasons, the United States and its “Five Eyes” security allies (Australia, Canada, New Zealand, and the United Kingdom) have banned TikTok on all government-issued devices.
